1. General provisions
- These terms set out the rules for using the website https://babysos.lifenexa.pl, the web customer panel and the BabySOS mobile app (together: the “Service”).
- The Service is provided by LifeNexa (the “Provider”). Contact: servicetunfiles@gmail.com.
- BabySOS is a tool for parents of young children: a daily schedule, feeding, sleep and diaper logs, information for first responders, and safe sharing of selected information with caregivers such as grandparents or a babysitter.
- In these terms: Parent means an adult who created an Account; Caregiver means a person to whom a Parent has shared selected information about a child using a link, QR code or 6-digit code; Account means a Parent's set of data and permissions in the Service; Caregiver Access means a time-limited, scope-limited permission to view and record selected information about a child.
2. Requirements and availability
- To use an Account you need a device with Internet access, a current browser or an Android phone (the installation file is available on https://babysos.lifenexa.pl; an iPhone version and store releases are planned), and an e-mail address.
- A Caregiver uses Caregiver Access in an ordinary browser – no account and no app installation required.
- The Service is provided electronically. Internet costs follow the user's telecom tariff.
3. Account
- An Account may be created by an adult with full legal capacity who is a parent or legal guardian of the child whose data they enter into the Service.
- Registration requires an e-mail address and a password. The data provided must be true. One e-mail address can be linked to one Account only.
- The Parent is responsible for keeping the password confidential and for all actions performed after signing in to their Account. Please tell the Provider promptly about any suspected unauthorised access.
- The contract for the Service is concluded when the Account is created and lasts until it is deleted.
4. Rules of use
- The Parent declares that they are entitled to enter the child's data into the Service and the data of people listed as emergency contacts, and that those people know their phone number is stored in the Service.
- In particular, it is forbidden to: share Caregiver Access with unauthorised persons, enter unlawful content or content infringing third-party rights, try to bypass security measures, disrupt the Service, scrape data automatically, or use the Service in breach of the law.
- The Provider may suspend an Account if its use breaches these terms or the law or endangers the security of the Service – after a prior request to stop the breach, unless delay could cause serious harm.
5. Caregiver Access
- The Parent decides on their own who receives information, in what scope (daily schedule, feeding, sleep, diapers, instructions, emergency contacts) and for how long. Health information (allergies, medication, other health notes) is off by default and requires a separate, deliberate consent from the Parent when the access is created.
- The link, QR code and 6-digit code contain only a secure access identifier – never the child's data. Anyone who holds the link or code can use it, so the Parent should pass it on only to trusted people.
- The Parent can revoke Caregiver Access at any time in the app or panel – the link and code stop working immediately. Time-limited access expires automatically.
- A Caregiver may record activities for the child (e.g. “milk given”) within the permissions granted by the Parent. The Parent may receive notifications about this.
- The Parent is responsible for choosing Caregivers and for whom they give access to.
6. SOS mode and emergency card
- SOS mode and the emergency card are informational only: they display data entered by the Parent and make it quicker to dial a phone number.
- BabySOS never places calls automatically, never transmits your location and never alerts emergency services. A call happens only after the user deliberately taps the “Call” button.
- In a life- or health-threatening situation, call the relevant emergency number straight away (112 in Poland and across the European Union), regardless of using the Service.
- The Parent is responsible for the completeness and accuracy of the data on the emergency card. The Service may be unavailable or slow (for example without network coverage), so it must not be relied upon as the only source of information in an emergency.
7. Plans and payments
- The FREE plan is free of charge with no time limit. PREMIUM and FAMILY are presented on the website as future paid subscriptions.
- Until payments are launched (planned together with the release in Google Play and the App Store) the prices shown are for information only and are not an offer within the meaning of the Civil Code. We do not charge any fees.
- Before payments are launched we will publish detailed subscription terms (price, billing period, renewal, cancellation, right of withdrawal) and inform you in the Service. Free safety features – including SOS mode – will remain available.
8. Availability and changes
- We work to keep the Service running without interruption but do not guarantee it. Interruptions may result from maintenance, failures or causes beyond the Provider's control.
- The Provider may develop, change or withdraw individual features and will give reasonable notice if a change materially worsens users' position.
9. Liability
- BabySOS is an organisational and informational tool. It is not a medical device and does not replace advice from a doctor, nurse or midwife, or contact with emergency services. Entries about feeding, sleep or medication are not medical recommendations.
- The Provider is liable in accordance with mandatory provisions of law. To the extent permitted by law the Provider is not liable for the consequences of incorrect, incomplete or outdated data entered by a user, for the operation of telecommunication networks and users' devices, or for the acts of people to whom a Parent has given access.
- The above does not exclude or limit the Provider's liability towards consumers to the extent it cannot be excluded or limited.
10. Intellectual property
All rights to the Service, its appearance, marks and website content belong to the Provider or its licensors. The user receives a non-exclusive, non-transferable right to use the Service for their own purposes within the scope of these terms. Data entered by the Parent remains the Parent's property.
11. Complaints
- Complaints about the operation of the Service may be sent by e-mail to servicetunfiles@gmail.com, describing the problem and giving the e-mail address linked to the Account.
- The Provider handles a complaint within 14 days of receiving it and replies to the sender's e-mail address.
- A consumer may use out-of-court complaint and redress mechanisms, in particular the help of a local consumer ombudsman and the information published by the Polish consumer authority UOKiK (uokik.gov.pl).
12. Termination and Account deletion
- The Parent can delete the Account at any time in the app or in the customer panel (“Account” tab). Deleting the Account permanently removes child profiles, daily schedules, recorded events, emergency contacts, instructions and all Caregiver Access grants; this cannot be undone.
- Before deletion you can download a copy of your data (JSON export).
- The Provider may terminate the contract for important reasons, in particular a gross breach of these terms, with 14 days' notice, unless the breach endangers the security of the Service.
13. Personal data protection
Personal data processing is described in the Privacy Policy, which forms an integral part of these terms.
14. Changes to the terms
- The Provider may amend these terms for important reasons, e.g. a change in law, in the scope of the Service, or for security reasons.
- We will announce a change in the app, in the panel or by e-mail at least 14 days before it takes effect. If a user does not agree to the change, they may delete the Account before it takes effect. Continued use after that date means acceptance of the change.
15. Governing law and final provisions
- These terms are governed by Polish law. For consumers this does not deprive them of the protection granted by mandatory provisions of the law of their country of habitual residence.
- Any disputes are resolved by the court competent under generally applicable rules.
- The terms are available at https://babysos.lifenexa.pl and can be saved and printed at any time.
